These Terms and Conditions (T&Cs) apply to all contracts made through the Curastate website between the website operator (hereinafter referred to as "Provider") and the users of the platform (hereinafter referred to as "Customer"). By using the website and utilizing our services, the Customer accepts these T&Cs.

2. Subject of the Contract

The Provider offers a platform that allows customers to create and publish real estate offers and to connect with potential buyers or tenants. The exact services provided depend on the chosen membership or service package.

3. Conclusion of Contract

A contract between the Customer and the Provider is established when the Customer uses the services provided on the website and accepts the T&Cs via the respective notice on the website. The Customer will receive confirmation of the acceptance of their offer via email.

4. Payment Terms

The use of paid services, especially for commercial customers, is subject to a fee. The amount of the fees is based on the price listed on the website. Payments are processed via the offered payment methods such as PayPal or Credit Card (Stripe). Invoices are issued electronically.

5. User Account and Registration

When registering, the Customer must provide complete and truthful information. The created account may only be used by the registered user. The Customer is responsible for keeping their password confidential and must inform the Provider immediately if unauthorized third parties gain access to the password.

6. Rights and Obligations of the Customer

The Customer agrees to ensure that all offers and content on the platform comply with applicable laws and regulations. The Provider reserves the right to remove inappropriate or illegal content and to block the Customer's access.

7. Liability

The Provider is only liable for intent and gross negligence. In the case of slight negligence, the Provider is only liable for the violation of an essential contractual obligation. In such cases, liability is limited to foreseeable, typical contractual damage. The Provider is not liable for damages caused by unauthorized third-party access to user data.

8. Right of Withdrawal

Consumers within the meaning of Section 13 of the German Civil Code (BGB) have a legal right of withdrawal if they use paid services. The exact withdrawal instructions and periods can be found in the respective order process.

9. Data Protection

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If any provision of these T&Cs is invalid, the validity of the remaining provisions remains unaffected.
